Rape of a Briton: a district court sentences the ex-employee of a hotel to 12 years in prison

Observing that by committing a heinous offense with the victim on Indian soil, the accused also tainted our country’s motto, ‘Atithi Devo Bhava’, the Chandigarh District Court on Monday found guilty and sentenced to 12 years in prison. jailing a former hotel worker who raped a British woman in Chandigarh in 2018.

The convict was also fined Rs 1 lakh.

In passing sentence on convict Farhan-uuj-Zama, Swati Sehgal Court, District and Additional Sessions Judge said, “With the increase in cases of rape and assault that foreign nationals are facing in India , a psychosis of fear has been created among tourists. Rape is not only a barbaric act committed with a woman’s body, but also leaves a scar on her mind and soul that never fades. The accused by committing a heinous offense with the prosecutor i.e. a foreign national on Indian soil has also tainted the motto of our country i.e. “Atithi Devo Bhava”. Such an act of the accused has tarnished the image of our country.

It was in December 2018 that the 50-year-old British national alleged rape in a hotel by her employee. According to the police, the accused had worked as a hairdresser-therapist since April 2016 in the hotel where the incident took place.

According to the prosecution, the woman had accused the employee of a hotel in the Rajiv Gandhi Technology Park, Farhan-uj-Zama, of touching her private parts during the massage when she had been told to massage only foot to knee when she was in the hotel’s spa and hammam on December 20, 2018.

The victim lodged his protest in front of the hotel management the same day and within hours the hotel management terminated Farhan’s services. The woman was in India with her friend on a tourist visa. The victim is a medical professional in the UK. A case under Section 376 (rape) was registered at the Chandigarh Computer Park Police Station. During the trial, the defense attorney argued that the defendant had been falsely implicated in the case and had committed no offence. The court, after hearing the case, found the defendant guilty and found him guilty of rape.
